Notice to Owner Template

A notice to owner is a formal written document sent by subcontractors, sub-subcontractors, and material suppliers to the property owner at the beginning of a construction project to inform them that the sender is furnishing labor, materials, or services on their property. This notice is a prerequisite for preserving mechanics lien rights in many states. Without sending a timely notice to owner, lower-tier parties in the construction payment chain may lose their ability to file a lien if payment disputes arise.

The notice to owner serves an important practical purpose beyond legal compliance. Property owners often have no direct knowledge of which subcontractors and suppliers are working on their project because they contracted only with the general contractor. The notice to owner bridges this information gap by making the owner aware of all parties contributing to the improvement of their property. This awareness helps owners ensure that payments made to the general contractor are flowing down to the workers and suppliers who are actually performing the work.

Our notice to owner template is organized by state because requirements vary significantly across jurisdictions. In Florida, for example, subcontractors and suppliers must serve a notice to owner within 45 days of first furnishing labor or materials. Other states have different deadlines, delivery requirements, and mandatory content. Our template guides you through the required fields including your company information, the property owner and general contractor details, a description of the materials or services being furnished, the project address, and the date you first provided labor or materials. The form can be printed and sent via certified mail with return receipt requested to create a clear record of delivery.
